HRW, Indonesia Selidiki Kerusuhan dan Izinkan PBB Masuk ke Papua

Pemerintah Indonesia didesak untuk melakukan penyelidikan independen terhadap kerusuhan Wamena, serta mengizinkan Komisi HAM PBB untuk masuk ke Papua memeriksa dugaan pelanggaran HAM di sana.

Desakan itu disampaikan oleh LSM Human Rights Watch (HRW) pekan ini, menyusul laporan tewasnya 33 orang serta 16.000 warga yang mengungsi akibat kerusuhan tersebut.

"Investigasi independen diperlukan untuk memeriksa peran aparat keamanan dan menuntut semua pihak yang bertanggung jawab dalam kerusuhan," kata Direktur HRW Asia Brad Adams dalam sebuah pernyataan.

Menurut dia, adanya pemantau independen "akan mencegah pelanggaran, baik oleh militan maupun aparat keamanan, sehingga akan menguntungkan semua warga Indonesia."

"Situasi di Wamena masih tegang, namun sulit untuk memverifikasi keadaan karena tidak ada wartawan yang bisa secara independen masuk ke sana untuk mewawancarai saksi mata," tambahnya.

Puluhan Warga Sipil Jadi Korban Kekerasan di Paniai

Jayapura- Puluhan warga sipil menjadi korban kekerasan di Paniai, Papua, selama Januari hingga April 2013. Tiga orang tewas, sedangkan yang lainnya diperlakukan tidak manusiawi oleh oknum petugas.

Mereka yang meninggal di antaranya ditembak orang tak dikenal, juga akibat tabrak lari kendaraan patroli Keolisian Resor Paniai pada 31 Desember 2012. Korban adalah Yakob Mote, 26 tahun, tewas di depan pos 571 Enarotali, Paniai. “Itu data sementara, masih harus diklarifikasi,” kata Kapolres Paniai Ajun Komisaris Besar Polisi Semi Ronny, Kamis, 18 April 2013.

Semi menegaskan, semua kasus yang melibatkan anggotanya sebagai pelaku, pasti akan ditindak tegas. Pihaknya pun sudah menarik personil Brimob sesuai tuntutan masyarakat.

Desakan agar personil Brimob ditarik disampaikan aktivis Papua dalam pertemuan tertutup dengan Pemerintah Kabupaten Paniai, Kepolisian/TNI serta DPR Papua. Sebab, dalam tiga bulan terakhir terjadi serentetan kasus diduga dilakukan aparat Brimob terhadap warga sipil.

“Kami mendesak Kapolri menarik Brimob dari Paniai, karena kehadiran Brimob membuat masyarakat trauma, ketakutan, dan menjadi korban kekerasan,” ujar Ketua Solidaritas Kekerasan Paniai Andreas Gobay.

Andreas juga meminta DPR Papua memfasilitasi Tim Solidaritas Peduli HAM bertemu Kapolri dan Panglima TNI agar pihaknya bisa menyampaikan kondisi kekerasan di Paniai. ”Dua institusi itu harus bertanggungjawab, yakni dengan memproses pelaku secara hukum,” ucapnya.

Bupati Paniai Hengky Kayame menegaskan, kekerasan bersenjata di wilayah pegunungan bagian barat itu terjadi tiap tahun. Karena itu masyarakat minta agar Brimob ditarik.

Menurut Hengky, pihaknya dihadapkan pada situasi sulit. Di satu sisi terdapat persoalan kesejahteraan, sedangkan di lain sisi timbul masalah keamanan. ”Sebelum saya dilantik sebagai bupati, daerah Paniai selalu bermasalah. Sekarang jadi bupati juga dihadapkan pada masalah,” tutur Kayame yang baru saja dilantik dua hari lalu.

Ketua Komisi A DPR Papua Ruben Magai menegaskan, konflik Paniai akibat ego dua pihak. OPM bersikukuh menyatakan Papua merdeka, sedangkan kepolisian dan TNI mempertahankan NKRI sebagai harga mati. ”Kalau semua pihak mempertahankan pendapatnya, konflik tak akan berakhir, masyarakat yang akan jadi korban,” katanya memaparkan.

Magai menyarankan agar pemerintah menjawab aspirasi dengan menyelenggarakan dialog antara Jakarta dan Papua sebagai jalan tengah bermartabat dan adil menuntaskan masalah Papua. ”Kalau tidak, korban akan terus berjatuhan,” ujarnya.

Konflik Papua karena Masalah Politik, Kemanusiaan dan HAM

JAKARTA - Anggota DPD RI asal Provinsi Papua Wahidin Ismail menilai konflik Papua terjadi karena ada masalah politik, kemanusiaan, dan pelanggaran HAM yang masih dianggap belum tuntas. Otsus pun belum terlaksana dengan baik, karena banyak anggaran yang tidak diperuntukkan bagi pembangunan Papua dengan benar.

"Karena itu, pemerintah harus berkomunikasi dengan baik dan konsisten dalam membuat kebijakan. Tak bisa melepas uang Otsus begitu saja, tanpa pengawasan yang ketat,” ujar anggota DPD RI asal Provinsi Papua Wahidin Ismail dalam diskusi di gedung Parlemen MPR/DPR/DPD bersama dengan sejarawan LIPI Asvi Warman Adam dan Wakil Ketua DPRD Papua, Jimmy Demianus Ijie, Senin (4/3/2013).

Wahidin mengatakan Presiden SBY tak perlu takut dialog. Sebab, mantan presiden alm KH. Abdurrahman Wahid (Gus Dur) telah memberi contoh yang baik melalui pendekatan kultural, dan dampaknya sangat positif bagi NKRI.

"Bayangkan Gus Dur begitu sampai di Bandara Cenderawasih langsung ziarah ke makam Theis H Eluway (Ketua Persedium Dewan Papua - PDP), itu sama dengan menghormati tokoh adat Papua,” ujarnya.

Hal yang sama diungkapkan Asvi Warman Adam, jika pendekatan kultural Gus Dur oleh pemerintah perlu ditiru. Apalagi penyelesaian setiap daerah itu memang tidak bisa disamakan dengan daerah yang lain.

“Gus Dur itu mengakui identitas adat Papua dan dialog pun tak membuahkan kemerdekaan sebagaimana yang dikhawatirkan. Hanya saja dialog itu perlu dirumuskannya mengenai siapa sebagai representasi warga Papua, materi atau substansi dialog, dan format dialog yang tepat yang bagaimana? Jadi, jangan menghindari dialog,” tegasnya.

Sedangkan Jimmy mengakui, memang ada pejabat Papua yang memperkaya diri dari dana Otsus tersebut, namun ada pula yang memelihara konflik. Mereka ini menjadikan Papua sebagai eksperimen politik.

“Selama 32 tahun Orde Baru keamanan PT Freeport dikendalikan oleh TNI Angkatan Darat, dan pasca reformasi diserahkan pada kepolisian, dan sekarang menjelang turunnya dana Otsus kembali terjadi penembakan, sehingga wajar kalau ada yang mencurigai adanya ‘permainan’ dan sengaja ‘memelihara’ konflik itu demi uang,” kata Jimmy.

Papuan accuses Indons of genocide

He escaped from prison while on murder and arson charges, spent two years on an international wanted list after Indonesian authorities alleged he was a terrorist and tomorrow he will arrive in Perth.

But West Papua independence movement leader Benny Wenda says Indonesian authorities - his accusers - are the ones guilty of terrible crimes.

He says they are the aggressors in a secret war of genocide being waged against his people less than 500km north of Australia.

Mr Wenda, who is on an international speaking tour to raise awareness about his people's fight for self-determination, said yesterday he was a peaceful political campaigner who was the victim of false allegations intended to silence him.

"They (Indonesia) always say that I am a criminal," he said.

"Actually, it's the other way around. Indonesia is the criminal. They illegally occupied my country and are killing my people."

Mr Wenda, 37, was arrested for murder and arson after allegedly inciting an attack on Indonesian police in 2000. But his Australian lawyer, Jennifer Robinson, said the charges were politically motivated and unfounded. She said Mr Wenda was in a refugee camp in Papua New Guinea at the time of the attack.

"The prosecution was unable to produce any credible evidence," Ms Robinson said. "The judge accepted three witness statements from police from three people we could not identify and they were unable to bring to the courtroom."

In 2002, Mr Wenda escaped from jail through a ventilation shaft, crossed into PNG and went to Britain, which gave him political asylum.

In 2011, Interpol put him under a red flag notice after Indonesia added terrorism to the allegations against him. After a two-year legal battle, his name was cleared and the flag removed.

The catalyst for his activism came when, as a five-year-old in West Papua's central highlands, he allegedly saw Indonesian soldiers rape his aunts and brutally beat his mother.

"I tried to help my mum," he said. "Her face was bleeding right in front of my eyes. I couldn't do anything. I just cried."

Mr Wenda claims that since West Papua voted to become part of Indonesia in 1969 - a ballot he says was forced at gunpoint - authorities have killed about 500,000 West Papuans in their crackdown on separatists. He said many recent killings were by a squad of crack troops known as Detachment 88, who get support from Australia.

WA Greens senator Scott Ludlam, who will speak with Mr Wenda in Perth and echoed the Papuan leader's concerns about Australia's links to Detachment 88, said the people of West Papua had a legitimate claim to self-determination and should not be treated like criminals.

Amnesty International and the Australian Government have urged Indonesia to investigate alleged human rights abuses in Papuan provinces.

A Department of Foreign Affairs and Trade spokesman said Australia backed Indonesia's sovereignty over the Papuan provinces and that Detachment 88 received help from Australian Federal Police for investigations and forensic assistance.

Mr Wenda said he had never taken up arms for his cause and believed peaceful, political lobbying was the way forward.

"The world is changing," he said. "We don't have any power to resist through the gun.

"The powerful weapon is the peaceful way. The powerful weapon is the truth."

Warga Papua Trauma Penanganan Konflik

VHRmedia, Jayapura – Aliansi Demokrasi untuk Papua menuntut aparat keamanan tidak menggunakan cara kekerasan untuk menangani konflik di Papua.

Menurut Direktur Aliansi Demokrasi untuk Papua, Anum Siregar, penanganan konflik saat ini cenderung represif dan menimbulkan trauma warga. Tidak tertutup kemungkinan, kekerasan yang dilakukan aparat justru memicu serangan balik yang lebih besar. 

“Kekerasan bukan saja terjadi di tempat terpencil tapi juga di tengah kota. Aksi itu menyebabkan kematian, menggunakan cara-cara yang menimbulkan ketakutan, dendam, dan trauma yang luar biasa,” kata Anum Siregar di Jayapura, Rabu (2/1)

Aliansi Demokrasi untuk Papua mencatat, terjadi peningkatan jumlah dan skala kekerasan di Papua sejak Juni hingga Desember 2012. Kasus tersebut antara lain, penyerangan pos kepolisian di Pireme, Kabupaten Lanny Jaya, pembakaran rumah adat di Wamena, dan penembakan 4 nelayan di Raja Ampat pekan lalu.

Cara penanganan yang dilakukan polisi juga terkesan represif. Aparat keamanan sering melekatkan stigma residivis, separatis, atau anggota Komite Nasional Papua Barat untuk aktivis pro kemerdekaan Papua. 

“Seolah dengan stigma tersebut perlakuan sewenang-wenang dapat dibenarkan. Seperti pembunuhan Timo Ap di Manokwari dan kasus kematian tahanan politik Hubert Mabel di Wamena,” ujar Anum Siregar.

Kemampuan polisi untuk mengungkap kasus kekerasan di Papua juga dipertanyakan. Polisi hingga sekarang belum mampu mengungkap pelaku dan motif sejumlah aksi kekerasan di Papua. 

Padahal kata Anum Siregar, kegagalan aparat mengungkapkan kasus-kasus dugaan pelanggaran HAM akan menghilangkan kepercayaan publik terhadap penyelenggaraan pemerintahan yang tertib hukum.

Penembakan Nelayan Raja Ampat

Terkait penembakan 4 nelayan di Kabupaten Raja Ampat yang diduga dilakukan personel TNI, Direktur Eksekutif Lembaga Penelitian, Pengkajian, dan Pengembangan Bantuan Hukum (LP3BH) Manokwari, Yan Christian Warinussy menilai, kasus tersebut sebagai pelanggaran berat HAM.

Yan Christian Warinussy meminta Komisi Nasional Hak Asasi Manusia menyelidiki kasus tersebut. itu. “Ini kejahatan terhadap kemanusiaan,” ujarnya.

Panglima Kodam XVII Cenderawasih, Mayjen TNI Christian Zebua mengatakan, pihaknya akan menjatuhkan sanksi jika terbukti pelaku penembakan adalah anggota TNI. 

Pada 20 Desember 2012, empat nelayan asal Pulau Buaya tewas ditembak di perairan Pulau Papan, Distrik Misoll, Kabupaten Raja Ampat. Korban tewas adalah La Huni (70 tahun), La Jaka (30 tahun), La Idi (22 tahun), dan La Diri (30 tahun). 

Sedangkan 2 korban selamat La Anu (20 tahun) dan La Udin (30 tahun) masih dirawat di RSUD Kota Sorong. Polisi dan TNI masih menyelidiki pelaku dan motif penembakan ini. (E1)

A West Papua National Committee (KNP activist has been killed, and a farmer has died from his wounds in hospital, after being shot by members of the Australian-trained anti-terror unit Detachment 88 outside Wamena on December 16, following raids that arrested at least six activists on Sunday morning, according to multiple sources.

KNPB activist Hubertus Mabel (aged 30) died shortly after being taken by police to Wamena hospital after the shooting at 1030am in the village in Milima (or Kugima) in Kurulu district outside Wamena. Local farmer Natalis Alua (34) died in coma in hospital after being shot in the same incident, according to latest reports from human rights sources in Wamena.

According to journalist Victor Mambor, at this time Hubert was still alive and this was confirmed both by the police and Victor Yeimo (National KNPB Chairman). "Police told me that Hubert was shot in the leg at 09.30 (morning). Hubert was taken to hospital by police and then died at the hospital because of loss of blood.... At 6 (afternoon), Hubert claimed by police died in hospital."

"Some peoples in the Kugima Village, the place where Hubert was shot, told us police entered the village in full force. They brought two people who had been arrested before (Meky Kogoya and Wene Gombo) to the village to tell them where Hubert lived."

At 9am, the same joint police/army and Densus 88 squad conducted a armed raid in the village of Kosi Hubi Holima, in Wamena. KNPB Wamena Chairman Simion Daby was arrested with human rights activist Baroy Sambon, Meki Jikwa (Kogoya), John Huby, Pie Huby, Herae Huby, and Ima Mebel, allegedly at the house of Meky Kogoya, who was accused by police of being responsible for a bombing incident in Wamena. They were all taken forcefully by police to Jayawijaya police headquarters.

It is believed that human rights worker Sambon was arrested as he was trying to alert international media to the situation, but this has not been verified.

The KNPB have repeatedly denied involvement in planning or carrying out acts of violence or bombings in Papua, a view supported by the Churches, human rights organisations and legal networks in Papua. Police have yet to provide any credible evidence that shows their involvement, despite millions of dollars being provided to Densus 88 by Australia for forensic evidence analysis.

Alleged TPN retaliation questioned
There have been reports of an alleged West Papuan National Liberation Army (Tentara Pembebasan Nasional or TPN) retaliation against police over the shooting of Hubertus Mabel, but human rights workers have cast doubt on the involvement of TPN forces, instead accusing Indonesian security forces of acting up to continue to create a false scenario for conflict.

According to a report in Tabloid Jubi, the sound of gunfire could still be heard up to 11pm on 16 December in Wamena.
'On 10.25pm, there was an exchange of fire between the TPN-OPM (the military wing of the OPM) and the TNI/Polri , Indonesian army and police, somewhere between Misi Market and Sinakma, Yusodarso Road. The situation in Wamena was said to be tense and there were calls for help,' according to a local report as quoted by Jubi.A local resident, Yason, confirmed reports of the sound of gunfire which was still continuing. It is alleged that this was in response to the shooting of Hubertus Mabel. Another local resident named Vita told JUBI that the local police station had been burned down in response to the shooting of Hubertus Mabel. According to Vita, 'Mabel and member of the KNPB was shot by the security forces as he was suspected of a bombing the Wamena, which led to the police station being burned down.'The local police chief later confirmed to JUBI that there had been an exchange of fire, but West Papua Media was unable to find any witnesses or evidence that any armed TPN unit was in the area.

However long time human rights worker Markus Haluk told West Papua Media that local investigators had been visiting witnesses and have compiled a chronology that sits at odds with this account. According to Haluk, at around 8pm local time, a number of drunk people set fire to one market stall at Pasar Misi/Bungsu. Haluk also reported that at 11pm local time, police arrived on the scene with the Deputy Chief of Jayawijaya Police and opened fire with a barrage of shots, all from one side, with no clear target apart from civilians who had gathered. Police then moved to the Dewan Adat Papua offices less than a kilometre from the scene, and set fire to them in retaliation, despite the burning market stalls having no connection to either the DAP leader or council staff.

Markus Haluk said that the "Alleged drunks burning kiosks in the market (is) scripted by the security forces to divert attention from the arrests and shootings of civilians and KNPB activists, and is a conscious Scenario consciously to burn the office and create psychological pressure against the leaders and members of the Papuan Customary Council Lani Pago Baliem Region."

Local human rights workers believe this latest round of security force misbehaviour is due to the payment to the new Papua Police Chief Tito Karnavian (former Densus 88 commander) of Ten Billion Rupiah (approx US$1 million) from the Papuan Governors office, for the provision of "Phase 2" security for the Papuan Gubernatorial Election campaign, which was also earmarked to maintain a peaceful environment in the lead-up to Christmas.

"Many parties are upset with these incidents," said Haluk. "For catching, shooting in Wamena occurred on Sunday, when people were seeking to church to worship. While the arson of the DAP offices were do middle of the night, when the community was quiet for the night, " he explained.

"On receipt of the funds, the Papua Police Chief conveyed the importance of maintaining the security and peace of Christmas and the election of Governor. Instead, he led police officers making arrests, shootings and arson of Balim Traditional Council offices," an exasperated Haluk told West Papua Media.

These arrests come amidst a major series of operations by Indonesian security forces across Papua on the anniversary of the Densus 88 assassination of legendary TPN guerrilla leader Kelly Kwalik on December 16, 2009. Heavily armed Densus 88 personnel, including an unidentified Australian man, were seen to be guarding Kelly Kwalik's tomb to prevent a memorial service from being held to commemorate the anniversary of Kwalik's extrajudicial execution.


Also, in news from the Paniai, Brimob paramilitary police have reportedly shot and captured Yakobus Utii in Enarotoli on Sunday, alleging that he was a senior figure in Jhon Yogi's TPN command.

Dua aktivis Papua Barat ditembak Polisi Indonesia

Di tahun 2012 sejauh ini, 22 anggota  Komite Nasional Papua Barat (KNPB) tewas, tiga hilang, tujuh telah didakwa dengan pelanggaran berbagai ketegangan dan tuduhan.

Kepolisian Indonesia telah menembak mati dua aktivis Papua Barat dan membakar sebuah rumah di kota Wamena provinsi  Papua yang digunakan sebagai kantor "Dewan Adat" untuk pertemuan masyarakat.

Hubertus Mabel, 30, Komisioner Militansi KNPB dan Natalis Alua, anggota Komite Nasional Papua Barat (KNBP) ditembak di luar sebuah rumah di desa Kurulu di sekitar jam 11 pagi pada hari Minggu, dan kemudian meninggal.

Para aktivis mengatakan rumah milik keluarga Hubertus dan dia ada di sana untuk merayakan Natal.

Sejauh tahun ini, 22 anggota KNPB tewas, tiga hilang, tujuh telah didakwa dengan pelanggaran berbagai dan lebih dari 200 ditangkap namun dilepaskan dalam waktu tiga bulan.

Penembakan mungkin baru  menunjukkan retak-down pada aktivitas separatis di bawah Kapolda baru dari Papua polisi, Tito Karnavian, yang sebelumnya kepalai kontra-teroris unit polisi Densus-88, yang sebagian dilatih dan didanai oleh Australia.

Australia bersikeras bahwa Papua Barat harus menjadi bagian dari Indonesia, dengan Menteri Luar Negeri Bob Carr mengatakan baru-baru itu "benar-benar tak terbayangkan" bahwa "beberapa pengaturan lainnya" bisa terjadi.

Setelah insiden terbaru, tiga orang membakar sebuah pos polisi kecil kayu di pasar Wamena, suatu tindakan yang tampaknya diminta polisi untuk pergi ke Kantor Tribal kota yang digunakan untuk pertemuan masyarakat dan juga membakarnya ke tanah.

Juru bicara polisi, Kombes Gede Sumerta Jaya, membantah polisi sengaja membunuh dua orang.

"Itu bukan penembakan, itu adalah upaya untuk menangkap seseorang yang melanggar hukum," kata komisaris Gede.

Dia mengatakan dua polisi pergi ke rumah di desa sekitar 30 menit dari Wamena karena mereka telah menerima informasi bahwa salah satu orang yang bertanggung jawab untuk merencanakan serangan terhadap kantor polisi Pirime, yang menewaskan tiga polisi pada akhir November, ada di sana.

Komisaris Gede mengatakan bahwa, di rumah, polisi kalah jumlah oleh Mr Mabel dan empat dari teman-temannya, yang bersenjatakan parang.

"Petugas kami memerintahkan mereka untuk meletakkan senjata mereka tetapi mereka tidak mendengarkan. Bahkan mereka datang ke dua petugas dan berusaha untuk mengambil senjata petugas 'dari tangan mereka," kata Komisaris Gede.

Imam Katolik John djonga kepada Fairfax ia telah mencoba untuk melihat sore kemarin Hubertus tubuh itu, "tapi tidak bisa karena banyak petugas polisi menjaga rumah sakit".

Pemimpin KNPB Victor Yeimo membantah versi polisi sebagai "propaganda untuk membenarkan laporan polisi".

 

"Polisi Indonesia melalui Kepala Polda Papua, Tito Karnavian dan tentaranya, Densus 88, telah membuat skenario melalui label aktivis KNPB di Wamena sebagai teroris," kata Yeimo.

Dia menegaskan bahwa Mr Mabel adalah "salah satu pejuang kemerdekaan yang [adalah] militan dan radikal," dan telah membantu "memperkuat perlawanan" dari KNPB.

"Dia telah menginspirasi begitu banyak pemuda Papua Barat untuk berdiri kuat dalam memperjuangkan hak kebebasan," kata Yeimo.

Mr djonga mengatakan api kemudian di Kantor adat telah dinyalakan atas perintah wakil kepala polisi Wamena sendiri.

The Foreigners involvement in Papua Conflict

An Australian received military training in the Ukraine and was travelling to West Papua to engage in “violent conflict” against the Indonesian government as a mercenary when intercepted by Australian authorities as he was about to board a flight to Papua New Guinea, a court has heard.

Gerard Michael Little, 45, who trained at the International Bodyguard Association in Ukraine, was refused bail in the Brisbane Magistrates Court on Wednesday (05/12) after being charged with committing preparatory acts or performing drills for incursion into foreign states.

Little was seized in a multi-agency sting led by the Australian Federal Police at the Brisbane International Airport on Tuesday night as he tried to board a flight to Papua New Guinea, from where he intended to “island-hop” to West Papua, the court heard.

Commonwealth prosecutor Justin Williams said Little made admissions to police about his intentions and told them he had undertaken training in Ukraine in August.

He said the strength of the crown case was “overwhelming” and opposed bail on the grounds Little was a flight risk.

Magistrate Jacqui Payne refused Little’s bail application, saying there was an unacceptable risk he would flee.

Little allegedly told police in 2003 that he did not recognise the sovereignty of Australia or its laws.

The case was adjourned until January 18 for mention.

Australia fully recognises Indonesia’s sovereignty over its Papua and West Papua provinces. Australia’s support for Indonesia’s control was explicitly set out in the 2006 Lombok Treaty.

Asked about the position earlier this year, Foreign Minister Bob Carr said: “It would be a reckless Australian indeed who wanted to associate himself with a small separatist group which threatens the territorial integrity of Indonesia.”

In Papua New Guinea on Wednesday, Senator Carr told reporters it was a matter for the courts and declined to comment.

Meanwhile, in Indonesia’s West Papua province, police arrested a Ukrainian citizen during a rally dedicated to the 51st anniversary of the separatist movement of Free Papua Organization (OPM) on December 2nd.

Artem Shapirenko, 36, who entered Indonesia on a tourist visa that expired four months ago, joined the rally and yelled “Papua Merdeka” as police caught him.
