AWPA: 50 tahun Pelanggaran HAM berlangsung, tak ada perbaikan di Papua

JAKARTA: The Australia West Papua Association menilai kekerasan dan pelanggaran hak asasi manusia (HAM) terus berlangsung selama 50 tahun di Papua sejak diambil alih pemerintah Indonesia dari United Nations Temporary Executive Authority (UNTEA) pada 1963.
AWPA, organisasi pemantau HAM yang berbasis di Sydney, Australia, mengatakan pelanggaran HAM, operasi militer dan eksploitasi sumber daya alam di Papua masih berlangsung hingga kini. Organisasi itu menuturkan manfaat sumber daya alam di sana sedikit sekali manfaatnya bagi orang Papua.
AWPA menyatakan masalah di Papua Barat tidak akan selesai dengan mengirimkan lebih banyak pasukan atau operasi militer. "Pada 2013, sudah 50 tahun pemerintah Indonesia mengambil alih pemerintahan Papua Barat dari UNTEA. Orang-orang Papua hingga kini masih berjuang untuk keadilan dan penentuan nasib mereka sendiri," tulis AWPA dalam laporan HAM 2012 pada situsnya yang dikutip Jumat (04/01/2013).
Organisasi itu mendesak agar pemerintah Indonesia menerima tawaran dialog dari perwakilan orang-orang Papua untuk menuntaskan masalah yang dihadapi selama ini. Selain itu, AWPA menyatakan, pihaknya mendesak agar seluruh pelanggaran HAM yang dilakukan oleh pasukan keamanan diselidiki dan dituntut.
Pada Oktober 1962, UNTEA didirikan sebagai administrator dan juga membawa misi perdamaian melalui pengamatan militer. Hal itu dilakukan karena Papua, yang saat itu bernama Western New Guinea, menjadi objek sengketa politik antara Belanda dan Indonesia. Berdasarkan Wikipedia, UNTEA juga memediasi keduanya dengan perjanjian New York yang akhirnya menetapkan penyerahan wilayah itu ke Indonesia pada Mei 1963. Western New Guniea akhirnya berubah menjadi Irian Barat dan kemudian Irian Jaya.
"Tak ada perbaikan dalam situasi HAM di Papua pada 2012. Bahkan situasinya terus memburuk dengan ditargetkannya para pembela HAM dan demonstran damai oleh pasukan keamanan Indonesia," demikian AWPA.
AWPA mencatat sejumlah kekerasan yang terjadi di Papua di antaranya adalah penembakan dan bentrok antara kelompok bersenjata.  Namun, reaksi pasukan keamanan terhadap hal itu adalah melakukan operasi militer yang membuat orang-orang lokal menjadi traumatis. Sejumlah aktivis Papua juga diadili karena dianggap makar namun polisi yang menyerang demonstrasi damai tak pernah dihukum, melainkan hanya dikasih peringatan.
AWPA juga mencatat sejumlah penembakan yang terjadi di Papua masing-masing terjadi pada 9 Januari, 2 Februari, 7 Februari, 9 Februari, 8 Maret, 26 Maret, 8 April, 14 April, 17 Mei, 29 Mei, 5 Juni, 7 Juli, 29 Agustus, 10 September, 14 September dan 28 Desember.  Di sisi lain, AWPA juga mendesak pemerintah Australia untuk meningkatkan perhatiannya terhadap pelanggaran HAM di Papua. Tak hanya itu, organisasi itu juga meminta agar Australia memikirkan ulang kebijakannya terjait dengan militer Indonesia.
"Papua Barat adalah tetangga terdekat kami. Orang-orang di sana menghadapi tantangan besar, termasuk pelanggaran HAM yang tengah berlangsung, eksploitasi sumber daya alam, minoritas di tanah mereka sendiri hingga wabah HIV/AIDS," kata AWPA.
Pada Juni lalu, Badan Pelayan Pusat Persekutuan Gereja-Gereja Baptis Papua mendesak agar Perserikatan Bangsa-Bangsa  segera mengirimkan pelapor khusus ke Papua untuk menyelidiki kekerasan dan pelanggaran HAM yang kian mencuat serta menimbulkan korban jiwa. Badan itu menyatakan para penembak lebih berkuasa dan terus mendominasi suasana di Papua dengan menghilangkan nyawa manusia. Hasil pemantauan persekutuan gereja-gereja itu memaparkan telah terjadinya kejahatan kemanusiaan yang menyebabkan korban jiwa maupun korban luka periode Mei-Juni 2012. (arh)

Journalist Manado Killed Due 14 Puncture

Manado-Aryono Linggotu, 26, a reporter from The Daily Metro Manado, North Sulawesi, was found dead in Jalan Daan 4, New Tikala Village, District Tikala, around 05.00 pm.


"Aryono confirmed murder victim. But until now we are still figuring out a motive for murder, "said the Head of Criminal Police in Manado, Nana Commissioner Nugroho, this morning.


The victim was found lying face down on the side under the bike. According to Nana, the condition of injured victims, estimated to murder more than two people. However, until now it has not know the motive of the murder.


The identity of the perpetrator is still unknown, petugsa still extract information that is known witness was with the victim shortly before the incident. The victim's body is now in the General Hospital Malalayang to dioutopsi.

Dua Advokat Israel Ditolak Masuk Indonesia

 Mereka hendak ikut Konferensi Hukum Asia di Bali.

VIVAnews - Entah berkaitan atau tidak dengan konflik yang pecah di Timur Tengah akibat invansi Israel ke Palestina, dua orang pengacara delegasi Israel tak bisa mengikuti pertemuan Konferensi Hukum Asia (Asia Law Conference) ke-25 yang digelar di Nusa Dua, Bali.

Dua orang delegasi Negeri Zionis itu ditolak masuk ke Indonesia. Mereka pun melayangkan protes ke Perhimpunan Advokat Indonesia (Peradi). "Saya mendapat pertanyaan dari mereka kenapa sampai tidak boleh masuk. Saya baru tahu masalah ini di menit terakhir sebelum konferensi dibuka," kata Presiden Peradi, Otto Hasibuan, di Nusa Dua, Bali, Senin 19 November 2012.

Mengetahui hal itu, Otto mengaku kaget. Pasalnya, pelarangan kedua peserta asal Israel masuk ke Indonesia lebih karena alasan politik. "Padahal kegiatan ini merupakan pertemuan tingkat dunia yang membicarakan masalah hukum dan jauh dari kepentingan politik," kata Otto.

Ia mengaku sudah membicarakan hal itu kepada Menteri Hukum dan HAM, Amir Syamsuddin. "Mestinya mereka boleh hadir, karena ini bukan pertemuan politik," ujar Otto.

Ia mengaku sudah berupaya membantu kedua delegasi tersebut agar dapat disetujui masuk ke Indonesia. Sayang, keduanya mengajukan proses keimigrasian di Bangkok, Thailand. Sehingga, katanya, belum diketahui benar masalah yang menjadi alasan pelarangan masuk ke Indonesia.

Sebelumnya, kasus serupa tak pernah ditemui sepanjang hajatan ini berlangsung di negara manapun. Ajang bergengsi ini sendiri dihadiri 400 peserta dari 27 negara. (umi)

Lawyer calls for 'inventory of all human rights abuses in Papua

Jayapura,-- The fact that many human rights violations which, according to the indigenous Papuan people, have occurred but have never been resolved, has drawn a comment from Budi Setyanto, a lawyer who is the director of the Institute for Civil Strengthening.

Describing this as a very serious matter, Setyanto said this was an extremely serious matter for the central and local governments and it should engage the government's earnest attention while the results should be made public.

What was needed, he said, was an inventory of all the cases that had occurred, those which had been solved through the courts and how they had been solved, as well as those that had not been resolved. And regarding those that had been solved, it should be clear which had been solved through the courts and those that had been solved by negotiation.

He said that according to the Papuan people, there were many cases that had never been properly solved.

'This matter needs to be resolved by the government which should make an inventory of all the cases that have occurred so that the general public is aware of the many cases that have not be resolved.'

In a statement to Bintang Papua, Setyanto said that this would show people just how many human rights violations had occurred.'

He said in addition that producing an inventory of all the cases would certainly find a response from the general public and a willingness to provide further information to the government, and more specifically to Komnas HAM (the national and well as the local Komnas HAM).

He also said that the Papuan provincial governors and their deputies as well as the provincial administrations should also be drawn into the work, and should set up a special team to draw up a comprehensive list of all the violations that have occurred. 'This is a matter, he said, 'that needs the full attention of the government and should not be dealt with in a half-hearted way.'

'If these human rights violations are not resolved comprehensively,' he said, 'the general public will consider this as being a very serious matter and will result in this problem triggering many demands from the people.. What is needed,' he said, 'is close collaboration between the government and the institutions responsible for the rule of law, as well as Komnas HAM.' so as to assure people that these matters are being taken seriously by the government.'

'At present, all we can say is that there have been many human rights abuses in Papua but we need reliable data about how many violations have occurred and the category of the abuses so that people can know what human rights restrictions exist, how the abuses have been handled and how they have been resolved.'
